These Business Terms apply to anyone listing a business on On Island, operated by Onisland.app LLC, a U.S. Virgin Islands limited liability company. They are in addition to our Terms of Service. If you sign up through the Business portal you agree to both, and we keep a record of your agreement (including the date, your IP address, and browser details) as a permanent legal record.
1. Listing eligibility
You may list a business if:
- You are the owner or an authorized representative of the business
- The business legally operates in the U.S. Virgin Islands
- You hold any USVI licenses, permits, or insurance required for your category (auto repair, plumbing, electrical, charters, water sports, etc.)
- You operate as an independent business, not as an employee of On Island
2. Approval, payment, and going live
Two things are required before your listing appears publicly:
- Approval. Every new listing is reviewed by our moderation team. We may approve or decline at our sole discretion — including for inaccurate information, missing licenses, or content that violates these Terms. If we decline after you have subscribed, we cancel the subscription: charges not yet settled are voided, and settled payments are reviewed for a refund.
- An active subscription. Approval alone does not make a listing visible. Your listing goes live when you also have an active subscription (including the founding free period).
After you are live, changes to your listing (except repositioning your map pin, which takes effect immediately) are reviewed by our moderation team before they replace the published version. Your live listing stays up unchanged while an edit is in review.
Listings within a category are ordered alphabetically. Every business pays the same subscription price, and no business can pay for a higher position in category or search results.
3. Subscription and payment
- Annual subscription: USD $180 per year. This is the only subscription plan.
- Founding Members: the first 25 approved businesses get their first 90 days free, then $180/year. Founding status and your founding number are awarded at approval, apply only to your first-ever subscription, and are yours permanently — but the free period is not repeated if you cancel and later resubscribe.
Payments are processed by Braintree, a PayPal service. Your card details go directly to Braintree; we never see or store your card number. By subscribing you authorize recurring annual billing. Subscriptions auto-renew unless canceled before the renewal date; we email renewal reminders 30 and 7 days ahead.
If a renewal payment fails, we email you and your listing stays up during a 7-day grace period while the charge is retried. If payment is still failing after 7 days, your listing is suspended and hidden from the directory until payment is resolved.
You can update your card or cancel your subscription any time from your business dashboard. Cancellation takes effect at the end of the period you have paid for — your listing stays live until that date, and we do not prorate or refund partial periods.
4. Premium Quick Access placements
Businesses in eligible categories (currently towing and car rental) may book the home-screen Quick Access cell for their category for a calendar month: $75/month off-season (May–November) and $100/month peak season (December–April). Each island has its own Quick Access placements: one business per category per month on each island, and a placement can only be booked by a business listed on that island. Where nobody has bought a month, that island's cell shows a top-rated listing instead. Booking requires an active subscription; the placement fee is a one-time charge on top of it, not a subscription.
The availability calendar is public, but who holds a future month is not disclosed until the placement runs. Placement purchases are final; contact support@onisland.app about billing errors.
5. Reviews
Customers can leave public reviews of your business. We do not edit, delete, or hide reviews to favor a business — including in exchange for payment. We moderate reviews that violate our content rules (defamation, harassment, spam, profanity).
6. Your content
By submitting a listing, photo, menu, or other business content, you confirm you have the right to do so and grant On Island a non-exclusive, royalty-free, worldwide license to display, adapt (for sizing and format), and promote it on the platform and in app marketing. Uploaded menus are machine-read (including optical character recognition) so customers can search their contents. You can request removal of your content at any time by contacting support.
Your business address and phone number appear publicly on your listing. A private contact address and your USVI license number, if provided, are visible only to our administrators and are used for verification and moderation — they are never published.
7. Acceptable use
In addition to the Terms of Service acceptable-use rules, you agree not to:
- Submit a listing for a business you do not own or represent
- Submit false license numbers, insurance status, or contact information
- Use customer information obtained through On Island for unrelated marketing
- Solicit reviews in exchange for compensation, or condition a discount on a positive rating
- Discriminate against customers in violation of US or USVI law
8. Independent contractor status
You operate independently and are not an employee, partner, joint venturer, or agent of On Island. You are responsible for your own taxes, insurance, equipment, licensing, and compliance with all applicable laws. Your subscription confirms the insurance and independence statements you accepted at signup.
9. Suspension and termination
We can suspend or remove a listing, with the reason recorded, for violation of these Terms or of law, or for repeated customer complaints. Suspension hides your listing but does not by itself stop billing; for a suspended listing we may also cancel the subscription, and in that case no automatic refund is made — a suspended business has had service, and any refund is at our discretion.
To close your account entirely, email support@onisland.app. We will remove your listing and public content; subscription and payment records, the signed agreement record, and moderation logs are retained as legal, tax, and accounting records.
10. Limitation of liability
In no event will On Island be liable for lost profits, lost customers, lost data, or other indirect or consequential damages arising from your use of the platform. Our total liability is limited to the amount you paid us in the past 12 months.
